TERMS OF WEBSITE USE

These terms of use (along with the documents they refer to) cover the ways you can access and use our website, whether you drop by as a guest or sign up as a registered user. That includes simply viewing pages, browsing, or creating an account. Please read them through before you start using the site — they will apply throughout. You may want to print a copy for reference. By using the site you confirm you accept these terms and intend to abide by them. If you cannot accept them, please do not use the site.

CHANGES TO OUR SITE

The site itself may change from time to time — the content is not fixed, and some of it may be out of date at any given moment. We are under no obligation to update it, and we do not promise that it is error-free.

ACCESSING THE SITE

Access is free, but access is also provided on a temporary basis. We cannot guarantee the site is always up or works without interruption. At any point we may suspend, withdraw, or alter any part of it without giving you notice, and we are not liable if something is unavailable at any time or for any length of time.

Arranging whatever you need in order to reach the site is down to you. It is also your responsibility to make sure anyone using the site through your internet connection knows about these terms (and the other applicable ones) and follows them.

ACCOUNTS AND PASSWORDS

If you choose — or we give you — a username, password, or other security credential, keep it confidential. Do not share it with anyone.

We can disable any login or password at any time, whether you picked it or we issued it, if we reasonably think you have broken any part of these terms.

We are not responsible for loss or damage caused by a virus, distributed denial-of-service attack, or any other technologically harmful content that ends up on your equipment, software, or data because you used our site or downloaded something from it or from a site linked to it.

We take no responsibility for the content of any external site linked from ours. Those links are not endorsements, and we cannot be held liable for losses that might follow from visiting them.

UPLOADS TO THE SITE

If a feature lets you upload content to the site or message other users, you need to follow the rules set out in our Acceptable Use Policy.

You guarantee that anything you contribute meets those rules, and you indemnify us for anything that does not. If you are a consumer user, that means you are on the hook for any loss or damage we experience because you breached that guarantee.

Anything you upload is treated as non-confidential and non-proprietary. You keep ownership of it, but you grant us and other users of the site a limited licence to use, store, distribute, and share it with third parties. The scope of that licence is covered just below (Rights you licence).

We also reserve the right to share your identity with any third party alleging that what you uploaded breaches their intellectual property rights or privacy.

We are not responsible, and not liable to any third party, for the content or accuracy of anything you or another user posts.

We reserve the right to take down any contribution we believe falls short of the Acceptable Use Policy.

Views posted by other users on the site are their own and do not reflect ours.

Backing up anything you upload is down to you.

RIGHTS YOU LICENCE

When you upload or post content to the site, you grant us the following licences:

  • a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the services we offer and to promote the site or those services across any medium; and
  • a worldwide, non-exclusive, royalty-free, transferable licence to let third parties use the content for their own purposes.

In practice we will only ever use what you give us to carry out your instructions — unless, in a rare case, a court or regulator directs us otherwise.

VIRUSES

We do not guarantee the site is secure or free of bugs or viruses.

Setting up your own device, software, and platform so you can get to the site is down to you, and you should run your own virus protection.

If it happens we will report it to the relevant authorities and cooperate by sharing your identity with them, and your right to use the site will end immediately.

LINKING TO THE SITE

You are welcome to link to any page on the site provided you do it fairly and lawfully, and without harming our reputation or piggybacking on it.

A link must not suggest any kind of association, approval, or endorsement on our part when none exists.

Only link to the site from a website that you own.

The site must not be framed on another site.

We reserve the right to withdraw permission to link at any time without notice.

Any site that does link to us must meet the content standards set out in our Acceptable Use Policy.

GOVERNING LAW

If you are a consumer, these terms — their subject matter and how they are formed — are governed by English law. You and we both agree the courts of England and Wales will have non-exclusive jurisdiction. Residents of Northern Ireland may also bring proceedings there, and residents of Scotland may bring them in Scotland.

If you are a business, these terms — and any dispute, contractual or otherwise, arising from them — are governed by English law. We both agree the courts of England and Wales have exclusive jurisdiction.
